MANUFACTURER WARRANTY

Every eyewear product (“Product”) sold by Safilo USA, Inc., New Jersey company with registered office at 300, Lighting Way, Secaucus, New Jersey (“Safilo”) is WARRANTED against hidden manufacturer’s defects of hinges, materials and/or workmanship for a 3-years period (36 months from the date of the original invoice), on condition that such defects are reported in detail to Safilo Customer Service within 30 (thirty) days from the relevant discovery through the dedicated on-line procedure available at mysafilo.com (warranty and returns page) and including the reference to the original invoice. Every Safilo Product is WARRANTED against visible manufacturer’s defects of hinges, materials and/or workmanship (i.e. any defect perceived by a person with normal vision, including those with corrective lenses, at 30 cm on a contrasting background) for 30 (thirty) days period from the issuance of the relevant invoice, on condition that such defects are reported in detail to Safilo Customer Service through the dedicated procedure available at mysafilo.com (warranty and returns page) and including the reference to the original invoice. Defective parts or frames will be repaired or replaced at no charge as long as the frame is still available and fails to perform satisfactorily while in normal use. In case of non-availability of the above mentioned remedies, any alternative remedy shall be at Safilo’s sole discretion. This warranty does not cover scratched frames or lenses, fractured or shattered lenses, or consequential, indirect or incidental damage, or aesthetic and cosmetic defects. SAFILO USA has sole discretion to determine manufacturer's defects. ALL WARRANTY CLAIMS ARE SUBJECT TO A CASE BY CASE EVALUATION. THIS PARAGRAPH SETS FORTH THE ONLY WARRANTY APPLICABLE TO THE PRODUCTS SOLD BY SAFILO. ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED. SAFILO SHALL IN NO EVENT BE LIABLE FOR LOST PROFITS, INJURY TO GOODWILL OR ANY OTHER SPECIAL OR CONSEQUENTIAL DAMAGES.


COMMERCIAL RETURN AND EXCHANGE OF PRODUCTS

Commercial returns of Products will be accepted by Safilo only in case such Products are purchased via Rx order and only on condition that they are returned no later than 30 (thirty) days from the issuance of the relevant invoice.


No exchange of Products is allowed without express prior authorization of Safilo authorized representative.


Provided the above, in any case:

  1. No pre-authorized return or exchange of Products will be accepted without completion by the customer of the dedicated on-line procedure available at mysafilo.com (warranty and returns page) and including the reference to the original invoice (in case of missing indication of the invoice, Safilo will refer to the most recent one issued for the same Products);
  2. No pre-authorized return or exchange will be accepted if the Products are sent to Safilo by the customer in unsaleable conditions;
  3. Safilo reserves the right to apply penalties to the customer in case of missing accessories;
  4. Any pre-authorized exchange of Products shall be within the same Products division, providing they are current, active in-line styles;
  5. Any special value frames purchased at reduced prices are final sale merchandise and are not refundable for exchange or return.
  6. Any pre-authorized credit for exchange of Products shall be subject to the following requirements:
From Customer invoice date:Credited value
From 0 to 36 months100% net invoiced price
From 37 to 48 months50% net invoiced price
After 49 months Fixed amount (Licensed brands $15; Proprietary brands $10)


MISCELLANEOUS

Unless otherwise agreed in writing between Safilo and the customer, any Product to be sent back to Safilo (defective Products, exchange or commercial return) shall be delivered, under customer’s responsibility, free of any marking, cleaned, demo lenses and accessories included (eg: cases and polybag) at the following address: Safilo Returns - Dock 60, 22905 E 19th Ave, Aurora, CO 80019.


This Service Policy is subject to change by Safilo without notice.


This Service Policy shall be read along with Safilo General Terms and Conditions of Sale (T&C) and it is an integral part of the T&C. In case of any conflict between the T&C and this Service Policy, this Service Policy shall prevail. This Service Policy shall prevail also on any customer’s terms and conditions and can be amended only upon written agreement between Safilo and the customer.


This Service policy shall be governed by and construed in accordance with the substantive law of New York. In any dispute that might arise over the validity, interpretation and/or performance of the Service Policy, the State and Federal courts of New York County shall have exclusive jurisdiction.
